HiFi Travel Booking Agreement

Please read this agreement carefully as it constitutes a legally binding contract.

1. BOOKING CONTRACT

When purchasing a product or booking a Trip with HiFi Travel, you are entering into a legally binding agreement on behalf of yourself and any guests. This agreement encompasses all transactions and services provided by HiFi Travel or third parties, including accommodations, transportation, event tickets, and additional services. By engaging in any transaction, you acknowledge and agree to be bound by the terms and conditions outlined in this Agreement, confirming that you are at least thirteen (13) years of age. Failure to agree to the Agreement means refraining from purchasing, enjoying, attending, or using any HiFi Travel services. HiFi Travel reserves the right to change or modify this Agreement at any time.

2. CLAIMS & COMPLAINTS

If you have a complaint about your Trip, notify our Support Team immediately for resolution. We are not liable for complaints that are not properly brought to our attention in a timely manner. Complaints must be submitted within 15 days of Trip completion via email to [email protected]. Any claims received after this period or through other channels may not be addressed.

3. EVENT TICKETS

Event Tickets are provided by third parties, and you must comply with their rules and regulations, as well as government protocols. You acknowledge that HiFi Travel is not responsible for events and that your admission can be refused or revoked by the third-party organizer. No refunds will be issued for denied access or ejection from an event. Reselling Event Tickets without consent is prohibited.

4. HOTEL ACCOMMODATIONS

Hotel Accommodations are provided by third parties, and you must adhere to their rules and regulations, as well as government protocols. Requests for specific rooms or beds cannot be guaranteed. HiFi Travel may substitute accommodations of similar quality if necessary. HiFi Travel is not responsible for hotel over-bookings, but we will assist in finding alternative accommodations. No refunds will be provided for denied access or ejection from a hotel.

5. ADD-ONS

Hotel Accommodations are provided by third parties, and you must adhere to their rules and regulations, as well as government protocols. Requests for specific rooms or beds cannot be guaranteed. HiFi Travel may substitute accommodations of similar quality if necessary. HiFi Travel is not responsible for hotel over-bookings, but we will assist in finding alternative accommodations. No refunds will be provided for denied access or ejection from a hotel.

5. REVOCABLE LICENSE

Your Trip is a revocable license from a third party, and they reserve the right to refuse admission or services to individuals who violate this Agreement, their rules, or applicable laws.

6. SEARCH, EJECTION, AND TERMINATION

You and your belongings may be searched by the third party providing goods/services upon entry to, or otherwise in connection with your attendance at, any event or premises in connection with your transaction at HiFi Travel, a third party, and/or the HiFi Travel website. You hereby consent to such searches by third parties and forever waive any and all related claims that could arise. If you elect to withdraw such consent to such searches, you may be denied access to the corresponding good, product, and/or service without refund or other compensation. Under certain facility rules, certain items may not be brought into certain events or premises, including, without limitation, alcohol, drugs, controlled substances, weapons, cameras, recording devices, laser pointers, strobe lights, irritants, and various forms of containers. Breach of this Agreement or any applicable third party’s terms, conditions, or policies may result in termination of your license to attend the corresponding event or activity or otherwise enjoy the applicable good, product, and/or service, without refund or other compensation.

7. PRICING & CORRECTION

HiFi Travel endeavors to publish and maintain accurate prices and information for its services. In the event, however, that a service is listed or provided at an incorrect price or with incorrect information due to typographical error or other error in pricing or service information received from our affiliates and/or providers, HiFi Travel retains the right to refuse or cancel any purchase for such services. HiFi Travel shall have the right to refuse or cancel any such purchase whether or not the order has been confirmed and/or your credit card charged. If your credit card has already been charged for the purchase and your purchase is cancelled because of incorrect information. HiFi Travel will promptly issue a credit to your credit card account in the amount of the charge.

8. THIRD PARTIES

The HiFi Travel website and other HiFi Travel documents display information which is provided by third parties and, as such, we cannot check or guarantee the accuracy of such information. Many of the goods and/or services which make up your Trip are provided by third parties in accordance with their own terms and conditions which may limit or exclude such third party’s liability to you. You understand that any violation of any third party’s terms and conditions may result in cancellation of your purchased good and/or service, in your being denied access to the applicable product/services, in your forfeiting of all monies paid, and/or in our debiting your account for any costs we incur as a result of such violation. HiFi Travel’s display of product options offered by third parties does not in any way imply, suggest, or constitute any sponsorship, recommendation, or approval of such third party or its goods or services by HiFi Travel. You agree that HiFi Travel is in no way responsible for the accuracy, timeliness, or completeness of information it may obtain from these third parties. You acknowledge that some third parties offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they

9. EVENT CANCELLATION, POSTPONED OR RESCHEDULED

In the event that the third party honors a refund for the Event Ticket portion of your purchase, HiFi Travel will issue a refund to you on the original method of payment (and, if made via a payment plan, the most recent form of payment) for the Event Ticket portion of your Trip ONLY – no other portion of your Trip is eligible for a refund. To be clear, for example, if your Trip includes an Event Ticket, Hotel Accommodations, and an Add-On, and the underlying event is cancelled, regardless of when the event is cancelled (i.e., 24 hours, 10 days, 30 days, 90 days, etc. before the scheduled event date), you are only entitled to a refund of the Event Ticket portion of your Trip and will not receive a refund for the Hotel Accommodations and/or Add-On. If the Event is postponed or rescheduled, you should check with the Event producer to obtain information on the Event and whether they are eligible for a refund or transfer.

WITHOUT LIMITING THE FOREGOING, IF A THIRD PARTY GOOD AND/OR SERVICE IS CANCELLED, IN WHOLE OR IN PART, RAINED OUT, POSTPONED, OR RESCHEDULED, AND THE GOOD AND/OR SERVICE WAS PART OF A HIFI TRAVEL TRIP, THEN HIFI TRAVEL WILL MAKE REASONABLE EFFORTS TO CAUSE THE APPLICABLE THIRD PARTY TO ISSUE A REFUND FOR THE VALUE OF SUCH GOOD AND/OR SERVICE IF POSSIBLE; HOWEVER, NEITHER HIFI TRAVEL NOR ANY APPLICABLE THIRD PARTY WILL BE OBLIGATED TO ISSUE YOU A REFUND FOR THE AFFECTED PORTION, OR ANY OTHER ASPECT, OF YOUR TRIP.

10. CANCELLATION BY TRAVELER

The Trip is non-refundable – if you elect to cancel the Trip or the Trip is cancelled due to your failure (or your selected travelers within your room’s failure) to finalize your Trip as set forth in Section 8 above, or any portion of the Trip, no refund will be given for any reason or under any circumstances. There are no exceptions to this cancellation policy, including but not limited to reasons related to weather; terrorism; civil strife or unrest; airline default; strikes; personal, family, or medical emergencies; or any other circumstances beyond our control. This means that even if you cancel because of medical issues, virus, sickness, quarantine, travel restrictions/warnings, fear of traveling, or any other reason, your booking will be subject to this cancellation and refund policy. If you are quarantined or a supplier refuses services if you exhibit symptoms of or test positive for infectious disease, we cannot provide refunds for any unused portion of your Trip. Moreover, we will not have any liability to you nor owe you any refund or compensation for loss, damage or injury, or anything else if you are infected with an illness, disease, or sickness during your Trip, or if a third party refuses services (e.g., lodging or transport) because you show symptoms of or test positive for infectious disease or illness before, after or during your Trip. For example, we will not be liable to you if you are: infected with a virus such as a coronavirus at Hotel Accommodations that we book for you, refused service at Hotel Accommodations, or are unable to board a plane to or from your Trip for showing symptoms of a communicable illness such as a cough or fever, denied entry by a government or municipality, required to self-quarantine, or for any other reason.

11. CANCELLATIONS AND CHANGES BY HIFI TRAVEL

HiFi Travel reserves the right to cancel, alter, or postpone trips without notice. We are not responsible for expenses or penalties associated with services booked separately. If a trip is cancelled or changed by HiFi Travel, refunds may be offered for the portion paid, excluding unrecoverable costs. We incorporate a non-refundable planning fee into the trip price.

12. IMAGES RELEASE AND SOCIAL MEDIA

You agree that HiFi Travel may use, re-use, link, repost, and/or reproduce any images, photos, videos, or written content (e.g., blog posts, articles) that you send to us or post online (including on social media) or which are captured by our guides, Trip leaders, and/or other travelers (whether of you individually or in a group) (referred to as “Content”). HiFi Travel may use the Content for promotional purposes worldwide without charge and without your right to inspection, in various mediums such as print, electronic media, or the internet. While we will strive to provide attribution when possible, we do not guarantee it. If you do not wish to grant this right to HiFi Travel, you must contact us in writing before your Trip begins and explicitly opt out of this section.
